Entire Agreement & Acceptance
These Terms and Conditions, together with the Quote, System Specifications and any Schedules, form the entire agreement.
- You acknowledge that you have not relied on any oral statements or representations not expressly included in writing.
- Acceptance occurs by signature, email or electronic confirmation, verbal acceptance, payment of any deposit, or instruction to proceed.
Any system modelling, savings estimates, payback calculations, simulations or performance projections are indicative only and not guarantees.
Australian Consumer Law & NETCC
- Nothing in this Contract excludes rights under the Australian Consumer Law.
- Where permitted by law, we may repair, replace or resupply goods or services.
- For non-household acquisitions, liability is limited to repair, replacement or resupply.
Scope of Services
Services are limited to those described in the Quote. Installation may be carried out by employees or subcontractors accredited by SAA and/or CEC.

Excluded Unless Stated in Writing
We are not responsible for equipment or systems not supplied or included in the Quote.
Performance, Savings & Tariffs
All performance, savings, export and rebate figures are estimates only. No guarantee is given regarding output, bill reduction, exports or feed-in tariffs.
- Retailers, DNSPs and regulators control tariffs and export conditions.
- Changes to incentives or tariffs do not constitute a defect or breach.
Pricing & Variations
Pricing assumes accurate site information and compliant infrastructure. Variations may arise due to DNSP requirements, compliance upgrades, access difficulty, additional cabling, trenching, council or strata requirements.
- If a variation is not accepted, refundable amounts will be returned less non-recoverable costs.
- Installation or services may be suspended where variations remain unpaid.
Cable Management
Additional cabling is chargeable. You authorise us to determine cable routes, conduit placement and surface mounting. If you are not present, installer decisions are final.
Payments, Deposit & Interest
Overdue amounts may result in interest, suspension of services, and recovery costs.
Cooling-Off Period
Where applicable, you may cancel within 10 business days of acceptance. No installation will commence during the cooling-off period unless permitted by law.
Rebates, STCs & Certificates
- You assign all rights to STCs, VEECs, PRCs and similar certificates.
- Incentives may be delayed, reduced or withdrawn.
- Rebated amounts remain payable if incentives change.
- Eligibility and processing time are not guaranteed.
Grid Connection & Export Limits
- Grid connection is subject to DNSP approval.
- Export limits or curtailment may apply at any time.
- If approval is refused, refundable amounts will be returned less non-recoverable costs.
Roof Conditions
Battery Safety, Location & Maintenance
- Batteries must be serviced only by accredited electricians.
- Required clearances and ventilation must be maintained.
- Installer compliance decisions are final.
Warranties
5-Year Workmanship Warranty
Applies to installation workmanship only. Product warranties are provided by manufacturers separately.
Warranty exclusions apply to misuse, modification or lack of maintenance.
Installation Delays & Force Majeure
Installation dates are estimates only. Delays may occur due to weather, supply chain issues or regulatory change.
No compensation is payable for delays beyond reasonable control.
Limitation of Liability
To the maximum extent permitted by law, Ares Energy Pty Ltd is not liable for indirect or consequential loss, including loss of profit, savings or tariff income.
Governing Law
The laws of the State or Territory of installation apply to this agreement.
Australian Consumer Law Notice
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us, and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
