    Terms and Conditions

    These Terms and Conditions form part of an agreement between Ares Energy Pty Ltd (ABN 78 631 734 506), referred to as “Ares Energy”, “us”, or “we”, and the customer named in the quote/contract, referred to as “you” or “your”.

    1. Acceptance

    • paying the deposit,
    • confirming acceptance by phone or email, or
    • signing and returning the contract (by post or email).

    2. Eligibility

    • You are at least 18 years of age,
    • You are the registered property owner of the installation address (or authorised by the owner),
    • You have read and accepted these Terms and Conditions.

    3. Payment

    • Payments may be made by EFT, bank cheque, cash, or credit card.
    • A deposit is payable upon acceptance of the quote.
    • The balance must be paid on or before the day of installation.
    • If payment is not received, Ares Energy may charge an admin fee and recover reasonable collection costs.

    4. Definitions

    • System: Solar PV, battery storage, electrical works, air conditioning, and related products quoted.
    • STCs: Small-scale Technology Certificates or other applicable government incentives.
    • Full System Design: The agreed design, specifications, and performance estimate attached to the contract.

    5. Our Obligations

    • Ares Energy will supply and install the quoted system at your installation address.
    • All installations will be carried out by licensed electricians and accredited installers, in compliance with Australian Standards.

    6. Your Obligations

    • Provide full and safe access to the property for site inspection, delivery, and installation.
    • Pay all amounts by the agreed due date.
    • Assign any applicable STCs to Ares Energy (unless otherwise agreed).
    • Be responsible for costs of meter upgrades, grid connection approvals, or additional site works (if required).

    7. Price Adjustments

    • Prices may change if government incentives (STCs, rebates) are varied or withdrawn.
    • Any site-specific variations will be discussed and agreed with you before installation proceeds.

    8. Cancellations & Termination

    • You may cancel this agreement within 10 business days (cooling-off period) for a full refund.
    • Either party may terminate the agreement if there are material legislative changes, or if unforeseen site conditions significantly increase project costs (in which case your deposit will be refunded).

    9. Refunds

    • The final system design is significantly different from what was quoted, and you do not approve it.
    • Installation cannot be completed within the agreed timeframe (unless you approve a revised date).
    • Ares Energy cannot obtain grid connection approval.
    • Quoted equipment is unavailable and you do not accept an alternative.

    10. Installation & Delivery

    • Ares Energy will aim to install your system by the agreed target date, subject to delays caused by weather, supply chain issues, or other unforeseen events.
    • You must provide safe and clear access to the property.
    • Final grid connection may require coordination with your electricity retailer or distributor.

    11. Warranties & Consumer Guarantees

    • All products include manufacturer warranties.
    • Ares Energy provides a 5-year workmanship warranty on all installations.
    • Your rights under the Australian Consumer Law apply in addition to these warranties.

    12. Ownership & Risk

    • Ownership of the system transfers to you once full payment has been received and any STCs are assigned to Ares Energy.
    • Risk transfers to you once the system has been installed.

    13. Governing Law

    This agreement is governed by the laws of Western Australia.
