Entire Agreement & Acceptance
These Terms and Conditions, together with the Quote, System Specifications and any Schedules, form the entire agreement.
- You acknowledge that you have not relied on any oral statements, representations, illustrations, simulations or estimates not expressly included in writing.
- Acceptance occurs by signing, email confirmation, verbal acceptance, or payment of any deposit.
If the physical site audit reveals unexpected layout constraints or roof shading that requires a structural configuration yielding a significantly degraded energy performance estimate compared to original sales expectations, and you do not consent to this variation, you retain an unpenalised right to terminate the contract and receive a 100% full refund of your deposit.
NETCC & Australian Consumer Law
- Ares Energy Pty Ltd is a NETCC Approved Retailer.
- Nothing in this Contract excludes or limits any rights under the Australian Consumer Law (ACL).
- Where a remedy is required under the ACL, Ares Energy may elect (to the extent permitted by law) to repair, replace or resupply the goods or services.
For all contracts initiated through unsolicited consumer channels (such as door-to-door or telemarketing), you possess a mandatory 10-business-day cooling-off period under the Australian Consumer Law. Your deposit is 100% refundable during this window.
Scope of Services
Services are limited strictly to those stated in the Quote. Installation may be carried out by subcontractors accredited by Solar Accreditation Australia (SAA) and/or the Clean Energy Council (CEC).

Performance, Savings & Tariffs
All performance, savings, payback, export and rebate figures are estimates only. We do not guarantee system output, bill reductions, export capability or feed-in tariff availability.
- Electricity retailers may change tariffs following installation. You must confirm suitability with your retailer.
If you are adding panels to, upgrading, or fully replacing a pre-existing solar configuration, your current Feed-in Tariff arrangement may be modified or permanently terminated by your retailer. Ares Energy accepts no liability for changes to pre-existing FiT entitlements. Under Western Australian regulations, residential installations exceeding 5 kW inverter capacity do not qualify for a standard Feed-in Tariff.
Pricing & Variations
Pricing assumes accurate site information and compliant infrastructure. Variations may arise due to:
If you do not accept a variation, you may terminate and receive a refund less non-recoverable costs already incurred.
Cable Management
Additional cabling is chargeable. You authorise Ares Energy to determine the installation method, including conduit, cutting concrete or trenching. Written notice of additional costs will be provided.
If you are not present, the installer's decision on cable routing is final. Re-routing is chargeable.
Payments, Deposit & Interest
A deposit is payable on acceptance. The balance due is payable upon delivery or installation.
If payment is overdue: warranty and after-sales services are suspended; interest applies at 10% per annum; and reasonable recovery, administrative and legal costs will be charged.
Rebates, STCs & Certificates
- You assign all rights in STCs and other certificates (including VEECs and PRCs).
- Incentives may be delayed, reduced, withdrawn or not implemented, and this is not a breach.
If a proposed rebate (including Federal Battery Rebates) is not implemented or is varied, you must pay the rebated amount.
Grid Connection & Export Limits
- Grid connection is subject to DNSP approval.
- Export limits, curtailment or dynamic controls may apply at any time and are not defects.
- If grid approval is refused, this Contract terminates and refundable amounts are returned.
If your electricity network provider enforces a partial or zero export limit that requires an Export Control Device or dedicated network meter to achieve compliance, the product and installation costs for that additional hardware shall be borne entirely by you.
Roof Conditions
Battery Safety, Location & Maintenance
- Batteries must only be serviced by SAA-accredited electricians.
- Flammable materials must not be stored near batteries.
- Clearance zones must be maintained at all times.
- Indoor batteries may require bollards at additional cost.
- Installer compliance decisions are final.
Under AS/NZS 5139:2019, batteries may only be installed in non-habitable, compliant locations. Any required pre-installation site modifications or structural additions (such as fire-rated backing boards or surface levelling structures) not explicitly itemised in your primary quotation will be treated as an additional cost.
Battery Backup & Blackouts
- Backup functionality is not included unless stated.
- Appliances exceeding inverter capacity will not operate during outages.
- Only essential circuits are recommended.
Insisting on additional circuits voids performance liability.
Battery Usage & Internet Connectivity
- Batteries must operate within manufacturer specifications.
- Internet connectivity is required. Prolonged disconnection may void warranty.
- Batteries left unused or uncharged may fail and are not covered under warranty.
- Batteries must be charged to at least 50% before extended shutdowns.
Warranties & Voiding
5-Year Workmanship Warranty
Applies to installation workmanship only. Product warranties are provided solely by manufacturers.

Installation Delays
- Installation dates are targets only.
- Battery installations may be delayed due to limited SAA-accredited installers.

Limitation of Liability
Nothing in this Contract excludes ACL guarantees.
To the maximum lawful extent, Ares Energy Pty Ltd has no liability for indirect or consequential loss, and any liability is limited to repair, replacement or resupply.
Indemnity
You indemnify Ares Energy Pty Ltd against loss arising from:
Complaints & Dispute Resolution
- Complaints must first be lodged with Ares Energy Pty Ltd.
- We will respond within 21 days, or advise if further investigation is required (with up to a further 24 days).
- Unresolved complaints may be escalated to Fair Trading, the Energy Ombudsman or a Tribunal.
Termination & Survival
Accrued rights survive termination of this Contract.
Governing Law
The laws of the State or Territory of installation apply to this agreement.
Privacy, Personal Information & Marketing Consent
We collect, use and disclose personal information in accordance with the Privacy Act 1988 (Cth). You consent to us collecting, holding, using and disclosing your Personal Information for:
Information may be disclosed to installers, manufacturers, DNSPs, regulators, rebate bodies, insurers and professional advisers. Monitoring data may be collected via third-party platforms.
You consent to receiving marketing communications relating to the System. You may opt out at any time. Our Privacy Policy is available at www.aresenergy.com.au.
Australian Consumer Law Notice
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us, and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Solar Care PRO Plan — Annual Maintenance Contract (AMC)
These terms apply specifically to the Solar Care PRO Plan (Annual Maintenance Contract) offered by Ares Energy Pty Ltd. By submitting an AMC enquiry, booking an AMC plan, or proceeding with service scheduling, you agree to the following terms.
Service Area
AMC plans are available exclusively within 50 km of Piara Waters, Western Australia. Properties outside this radius are not eligible for standard AMC pricing. Please call 1300 717 583 to discuss availability for your area.
Plan Tiers & Annual Pricing
Pricing is based on your solar system's total installed capacity:
- Up to 6.6 kW — $649 per year
- 6.6 kW – 10 kW — $799 per year (most popular)
- 10 kW – 15 kW — $999 per year
- 15 kW – 20 kW — $1,199 per year
- 20 kW – 25 kW — $1,399 per year
Prices are in Australian dollars and inclusive of GST. Pricing is fixed for the duration of each annual contract period and is subject to change on renewal.
What Is Included
Each AMC plan includes the following services, delivered across two visits per year (approximately every six months):
- 2× professional panel cleans per year
- Full system inspection (panels, inverter, and wiring) at each visit
- Loose connection check
- Basic fault detection and reporting
- Priority booking for scheduled and urgent callouts
- Written service report after every visit
- 10% discount on repair work carried out by Ares Energy during the contract year
The AMC plan covers the scheduled maintenance services listed above. It does not include the cost of replacement parts, repairs, inverter replacements, or any work beyond the scope of the two scheduled visits unless separately quoted and agreed.
Optional Add-Ons
The following optional add-ons are available to AMC plan holders:
- Extra Cleaning Visit — from $325 per visit (price varies by system size: $325 for up to 6.6 kW; $399 for 6.6–15 kW; prices for larger systems available on enquiry)
- WiFi Monitoring Setup — $132 one-time setup fee (compatible with most inverter brands)
Scheduling & Access
- Visit times are agreed between Ares Energy and the customer. A minimum of 24 hours' notice is required for rescheduling.
- The customer must ensure safe, unobstructed access to panels, inverter, and switchboard.
- If access is not available on the agreed date, a rebooking fee may apply.
Contract Period & Renewal
- Each AMC plan runs for 12 months from the date of the first scheduled visit.
- Plans do not automatically renew. You will be contacted prior to expiry to arrange renewal.
- Renewal pricing may differ from the initial contract year.
Cancellation
- You may cancel your AMC plan prior to the first scheduled visit for a full refund.
- Cancellation after the first visit has occurred will result in a pro-rata refund based on the unused portion of the plan, less an administration fee of $75.
- No refund is available after both scheduled visits have been completed.
Repair Discount
The 10% repair discount applies to repair work quoted and carried out by Ares Energy during your active contract year. It covers labour and materials supplied by Ares Energy. It does not apply to manufacturer warranty claims, third-party parts sourced independently by the customer, or work carried out by other tradespeople.
Capacity Limits
Ares Energy limits new AMC bookings to 10 slots per week to maintain service quality. Acceptance of your enquiry does not guarantee availability. Our team will confirm your booking upon contact.
One-Time Solar Health Check + Professional Clean
These terms apply to the one-time Solar Health Check + 1× Professional Clean service, available at $399 (limited-time price, regular price $499). This service is separate from the Solar Care PRO Plan (AMC) and does not constitute an ongoing maintenance contract.
- This service includes a single visit comprising one full system inspection and one professional panel clean.
- It does not include the second annual clean provided under AMC plans. For ongoing coverage with two cleans per year, see the Solar Care PRO Plan.
- A written service report is provided after the visit.
- Available within 50 km of Piara Waters, WA only.
- This service is available for systems up to 6.6 kW. Larger systems should enquire directly.
- The promotional price of $399 (saving $100) is subject to availability and may be withdrawn at any time.
- The 10% repair discount applicable to AMC plan holders does not apply to this one-time service.
- Cancellation with more than 24 hours' notice prior to the scheduled visit will receive a full refund. Cancellations within 24 hours may incur a cancellation fee of $75.
